Regulations on purchasing, selling, and transporting hazardous chemicals

The procurement, sales, and transportation of hazardous chemicals must comply with the following regulations:

（1） Procurement of hazardous chemicals

1. Hazardous chemical business units shall not purchase hazardous chemicals from enterprises that have not obtained the "Hazardous Chemical Business License". 2. Hazardous chemical units are not allowed to purchase hazardous chemicals from hazardous chemical production enterprises that have not obtained a Safety Production License.

3. Hazardous chemical units shall not entrust units without hazardous chemical transportation qualifications to transport hazardous chemicals when purchasing hazardous chemicals; Units without hazardous chemical transportation qualifications shall not be entrusted to hazardous chemical sales units, and the transported hazardous chemicals shall be inspected and stored.

4. Hazardous chemical units purchasing highly toxic substances must obtain a permit issued by the public security department for the purchase and transportation of highly toxic substances.

5. When hazardous chemical units purchase hazardous chemicals, it is necessary to require the production or operation units of hazardous chemicals to ensure the completeness and consistency of the purchased hazardous chemicals, including the Chemical Safety Technical Instructions and Chemical Safety Labels.

（2） Sales of hazardous chemicals

1. Units engaged in the production and operation of hazardous chemicals shall not sell hazardous chemicals to hazardous chemical production enterprises that have not obtained a Safety Production License.

2. Hazardous chemical production and operation units shall not sell hazardous chemicals to hazardous chemical operation enterprises that have not obtained the "Hazardous Chemical Operation License".

3. Hazardous chemical production and operation units shall not sell hazardous chemicals to hazardous chemical storage (use) enterprises that have not obtained the "Safety Assessment Review Opinion" and "Hazardous Chemical Storage (Use) Registration Certificate".

4. Units engaged in the production and operation of hazardous chemicals shall not entrust units without hazardous chemical transportation qualifications to transport hazardous chemicals when selling them; It is also prohibited to entrust hazardous chemical procurement units without hazardous chemical transportation qualifications to inspect and deliver goods.

5. Units engaged in the production and operation of highly toxic chemicals shall not sell highly toxic chemicals to individuals or units without purchase certificates or transportation permits.

6. Hazardous chemical production units must establish a registration system and archives for hazardous chemical containers and packaging materials, and shall not use hazardous chemical containers and packaging materials produced by non designated enterprises for packaging, containing, or transporting hazardous chemicals.

7. When hazardous chemical production units sell hazardous chemicals, they should attach the "Chemical Safety Technical Manual" and "Chemical Safety Label" that are completely consistent with the hazardous chemicals.

8. Individuals are not allowed to purchase highly toxic and explosive hazardous chemicals through the internet. The company shall not sell hazardous chemicals to individuals.

（3） Transport of hazardous chemicals

1. Hazardous chemical transportation enterprises must obtain the hazardous chemical transportation enterprise qualification approved and issued by the transportation or maritime department.

2. Drivers, crew members, loading and unloading management personnel, and escorts engaged in the transportation of hazardous chemicals by road and water must pass the examination of the legal department and obtain a job qualification certificate.

3. Hazardous chemical transportation enterprises are not allowed to transport hazardous chemical production enterprises that have not obtained a Safety Production License, hazardous chemical operation enterprises that have not obtained a Hazardous Chemical Business License, and storage (use) enterprises that have not obtained a Safety Assessment Review Opinion and a Hazardous Chemical Storage (Registration) Certificate. When transporting highly toxic products, the shipper's "Highly Toxic Product Procurement License" and "Highly Toxic Product Transportation License" should also be checked.

（4） Legal provisions related to precursor, explosive, and highly toxic chemicals (excerpt)

1. When selling highly toxic chemicals and explosive hazardous chemicals, hazardous chemical production enterprises and trading enterprises shall truthfully record the name and address of the purchasing unit, the name and ID card number of the operator, and the type, quantity and purpose of the highly toxic chemicals and explosive hazardous chemicals purchased. The retention period of sales records, copies of the identity certificate of the operator, copies of relevant license documents or supporting documents shall not be less than one year.

2. Sales enterprises and purchasing units of highly toxic chemicals and explosive hazardous chemicals shall, within 5 days after the sale or purchase, report the variety, quantity, and flow information of the highly toxic chemicals and explosive hazardous chemicals sold or purchased to the local county-level people's government public security organ for record keeping, and input them into the computer system.

3. Units that use highly toxic chemicals or explosive hazardous chemicals shall not lend or transfer the purchased highly toxic chemicals or explosive hazardous chemicals; If it is necessary to transfer due to changes in production, suspension of production, relocation, closure, etc., it shall be transferred to a unit with relevant permits or supporting documents, and the relevant situation shall be promptly reported to the local county-level people's government public security organ after the transfer.
